- Mitigating factors that may be misinterpreted
- Subjective evaluation of testing
YOU ARE NOT REQUIRED BY LAW TO SUBMIT TO A FIELD SOBRIETY TEST!
Field sobriety tests are designed to show physical or mental impairment; however, there are many other factors that can cause a person to do poorly on such tests. Nonetheless, the National Highway Transportation Safety Administration (NHTSA) has recommended specific instructions on the types of field sobriety tests conducted as well as how the tests are administered by a police officer.
The NHTSA provides the following as recommended field sobriety tests:
- The Horizontal Gave Nystagmus (HGN)
- The Walk-and-Turn (WAT) Test
- The One-Leg-Stand Test
Often a police officer will ask a suspect to perform other tests to show a mental impairment. These tests include:
- Counting backwards from 100 to a specific number
- Reciting the English alphabet without singing
However, these tests are not recommended by the NHTSA as a standardized field sobriety test battery.
